Legal Requirement to Notify USCIS About Change of Address
US immigration law requires all non-US citizens (this includes permanent residents) to notify U.S. Citizenship and Immigration Services (USCIS) of a change in address no later than 10 days after moving. You can notify USCIS earlier, but the legal notification deadline is 10 days after relocation. This reporting requirement does not apply to A and G visa holders and visa waiver visitors, but visa waiver visitors who are in the USA for more than 30 days may be required to update USCIS through the Alien Biographic Information (Registration) process.
Steps to Notify USCIS of a Change of Address
Notifying USCIS of your address change is a straightforward process. Here’s how you can do it:
Online Notification: Visit the USCIS website and create an account or log into your existing account. Once logged in, you can complete the Form AR-11 online. This is the easiest and fastest way to update your address. Additionally, if you have a pending immigration application or petition, the online AR-11 allows you to add the case number and will automatically update your address on that case. This only works if you filed the application or petition, so if you are only the beneficiary of a immigration filing, the system will not allow you to do this. Examples, H-1B employees, family-sponsored immigrants, and I-539A dependents cannot add the I-129, I-130, or I-539 case number to their AR-11 Change of Address form.
Mail a Form: If you prefer, you can still submit a paper Form AR-11 through the mail. You can download the form from the USCIS website, print it, fill it out, and send it to the address indicated in the instructions.
What Happens if You Don’t Notify USCIS?
Failure to notify USCIS of your change of address within the required 10-day period can lead to some serious consequences. First, it is a violation of US immigration law and can be used to deny you immigration benefits, fines, penalties, and/or imprisonment. When you have a pending immigration case, failure to update your address means you will not receive crucial notices from USCIS regarding your immigration case, which could lead to delays or even denial of your application. Additionally, it could impact your ability to receive interview notices or appointment dates, leaving you vulnerable if further action is required on your part.
In some cases, not providing this information could also pose complications in obtaining future immigration benefits. Therefore, it is always better to be proactive in keeping USCIS informed of your whereabouts.
Final Thoughts
In summary, it is essential to notify USCIS of a change of address within 10 days of your move. You can do this easily online or via mail. Keeping your address updated ensures that you remain informed about your immigration status and any needed actions that may arise. If you have questions or need assistance with the process, you can always schedule a legal consultation. By staying compliant, you minimize the risk of complications in your immigration journey.
